Illuminismo e Diritto Penale, 13 settembre ore 17:30
Il diritto penale moderno risale all’illuminismo settecentesco, quando vengono elaborati una serie di principi fondamentali che rappresentano un momento di svolta rispetto alla tradizione penalistica dell’ancien regime. I reati, le sanzioni e la disciplina processuale vengono ridefiniti. Con i suoi principali studiosi, come Montesquieu, Voltaire, Beccaria e Filangieri, si cerca di razionalizzare il diritto penale soprattutto muovendo dal piano della certezza del diritto e dell’equità delle pene. L’illuminismo ispirò importanti riforme legislative, come quella Leopoldina (del 1786), la dichiarazione dei diritti dell’uomo (1789) e il codice penale rivoluzionario del 1791 (modificato nel 1795). Partendo da questi presupposti, di illuminismo e diritto penale si parlerà il 13 settembre, alle ore 17,30, presso la Fondazione Banco di Napoli in un confronto che vedrà al tavolo dei lavori professori universitari, esperti in storia del diritto e diritto penale.
